How to Check If You’re Eligible

To determine if you qualify:

1. Review Your IRS Account

Log into your IRS account or request transcripts. Look for:

  • Penalties charged between 2020 and 2023
  • Interest on unpaid taxes
  • Fees related to late filings or payments

2. Identify Key Charges

Focus on:

  • Late filing penalties
  • Late payment penalties
  • Underpayment penalties
  • Interest charges

3. Consult a Tax Professional

A tax advisor, CPA, or tax relief specialist can help determine:

  • If you qualify under the new ruling
  • Whether to file IRS Form 843 (Claim for Refund)
  • The best strategy for maximizing your refund
  • Will the IRS Actually Issue Refunds?

There’s still uncertainty.

  • The IRS may appeal the court decision
  • Not all claims will be approved
  • Final outcomes depend on ongoing litigation

However, filing now could position you to benefit if the ruling stands.

I always pay taxes every year because of investments earnings although I have Social Security monthly income to support myself, but it has decreased for last year and this year.
