1. Guns

These items are hard to pass from one person to another, and because of this, they are some of the worst assets to inherit. The rules are different from state to state, and usually, you can’t hand it over if the other person doesn’t have a permit.

For instance, in New York, a decedent’s executor is not subject to criminal prosecution for as long as 15 days while in possession of the decedent’s firearms. This is considered to be a very short window of time. We say this because, in this time frame, the will doesn’t even have time to go through probate.

Typically, the executor or the heirs will contact the police to inventory and hold the firearms for up to a year while the will is being probated. The police have to take the guns because the heirs are not allowed to carry the firearms themselves.

Also, keep in mind that the hairs can’t keep the guns if they were not registered or properly registered by the decentes during their lifetime. That means the heirs will need to abandon them. This applies to fully automatic weapons, shotguns, or short-barreled rifles.

So, if you would like to let members of your family inherit guns, you better start preparing because they might need to have a firearm permit in order to accept them. Check out the laws at the National Rifle Association Institute for Legislative Action or the Giffords Law Center to Prevent Gun Violence.
